Terms of Service
Last updated: September 26, 2026
These Terms of Service (the “Terms”) govern access to and use of the otpcall.com website, the app.otpcall.com dashboard and the OTPCall API (together, the “Service”), provided by SIA BMI Group, a company registered in Latvia under Reg. No. 40103687008, VAT LV40103687008, Skolas 21 - 501F, Riga, LV-1001, Latvia (“OTPCall”, “we”, “us”). By creating an account or using the Service, you agree to these Terms on behalf of yourself and the organisation you represent (“you”, the “Customer”).
1. The Service
OTPCall provides phone number verification by telephone call: Flash Call (a code carried in the last digits of the calling number), Reverse Call (the end user calls a number we display) and Voice OTP (a spoken code). You integrate the Service into your own website or application through the API and receive the verification result on your server.
The Service is intended for businesses. You confirm that you use it in the course of your trade, business or profession and not as a consumer.
2. Your account
- You must provide accurate account and billing information and keep it up to date.
- You are responsible for all activity under your account, including requests made with your API keys. Keep API keys secret and on your server; notify us promptly at info@bmi.io if you suspect unauthorised use.
- We may verify your identity and business details before enabling the Service or specific destinations.
3. Acceptable use
You may use the Service only to verify phone numbers that your end users have provided and asked to verify in your product. You must not:
- use the Service for marketing, unsolicited or nuisance calls, or to contact anyone who did not initiate a verification;
- generate artificial or inflated traffic, including international revenue share fraud, traffic pumping or calls to premium-rate numbers;
- impersonate another person or organisation, or use the Service to deceive, defraud or harass anyone;
- break the law, including telecommunications, consumer protection and data protection rules that apply to you and your end users (for example the TCPA in the United States, the ePrivacy rules in the EU and Ofcom rules in the UK);
- probe, overload or interfere with the Service, or resell it without our written consent.
To protect the network and our customers, we may rate-limit requests, block destinations or number ranges and suspend traffic that appears fraudulent or abusive.
4. Your end users and their data
You are responsible for your relationship with your end users, including giving them the information required by law and having a lawful basis for verifying their phone numbers. When we process end users’ personal data to deliver the Service, we act as your processor as described in our Privacy Policy. A data processing agreement is available on request.
5. Coverage and verification results
Calls are delivered through third-party telecommunications carriers. Coverage, delivery rates, caller ID presentation and toll-free availability vary by country and carrier and may change. We do not guarantee that every verification call will be delivered or completed.
A successful verification confirms that the end user had access to the phone number at that moment. It is not proof of identity. You decide whether a result is sufficient for your sign-up, login, recovery or two-factor flow and remain responsible for your own security controls, including attempt limits.
6. Fees and payment
Fees are set out in your account, in your price list or in a separate order agreed with us. Prices shown on the website, including in the savings calculator, are illustrative and are not an offer. Unless agreed otherwise, a verification attempt is charged when the call is placed or received, whether or not the end user completes the verification. Fees exclude VAT and other taxes, which are added where applicable. If payment is overdue, we may suspend the Service after notice.
7. Availability and changes
We aim to keep the Service available and secure, but it may be interrupted for maintenance, carrier issues or events outside our control. We may improve or change features; if a change materially reduces the Service, we will give reasonable notice.
8. Intellectual property
We own the Service, including its software, documentation and brand. You receive a non-exclusive, non-transferable right to use the Service during your subscription in line with these Terms. You keep all rights in your own data and content.
9. Warranties and liability
Except as expressly stated in these Terms, the Service is provided “as is” and “as available”, without warranties of any kind to the extent permitted by law.
Neither party is liable for indirect or consequential loss, lost profits, revenue or data. Our total liability arising from or relating to the Service is limited to the fees you paid us in the 12 months before the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited under applicable law, including for fraud or intentional misconduct.
You will indemnify us against third-party claims, fines and carrier charges arising from your breach of Section 3 or from calls made to numbers you submitted in breach of the law.
10. Suspension and termination
You may stop using the Service and close your account at any time. We may suspend or terminate your access immediately if you breach Section 3, fail to pay, or if required by law or a carrier, and otherwise with 30 days’ notice. Fees for Service already used remain payable.
11. Governing law
These Terms are governed by the laws of the Republic of Latvia. Disputes are subject to the exclusive jurisdiction of the courts of Latvia.
12. Changes to these Terms
We may update these Terms. We will publish the new version on this page and, for material changes, notify account owners by email before they take effect. Continued use of the Service after that date means you accept the updated Terms.
